Optional Limited Damage Waiver (LDW)
- This is NOT insurance and is only for certain items.
- This fee is generally 10% of your item rental price and is NON-REFUNDABLE.
- You retain the full right to cancel or refuse this fee in which case we will request for a SECURITY DEPOSIT generally about 100% of you item rental price, and will be fully responsible for any damage or theft on your rental items up to the full current retail price of the item based on our price terms.
LIMITED DAMAGE WAIVER
(“LDW”) and you have paid the LDW fee prior to commencement of the Term, then with respect solely to the Item(s) covered by LDW (“Covered Items”), you will have no liability to Rollin Games LLC for 75% of the cost to repair or replace such Covered Items if and to the extent they suffer physical damage during the Term; except that you will remain liable to Rollin Games LLC for: (a) 25% of all repair/replacement costs for Covered Items; (b) ALL damage to or loss of Covered Item(s) caused in whole or in part by: (i) your breach of this Contract; (ii) theft or other failure to timely return
Covered Item(s) to Rollin Games LLC ; (iii) gross negligence, misuse and/or abuse of any Rented Item(s); (iv) vandalism and malicious mischief, (v) use of alcohol or drugs; and/or (vi) use of any Rented Item in violation of any law, Instruction, warranty or policy of insurance; and (c) all repair and replacement costs for damage to Covered Item(s) in excess of $5,000 in the aggregate across all
Rented Items.
LDW IS NOT INSURANCE, NOR IS IT A WARRANTY.
